Proving wrongful death and calculating your settlement
While wrongful death lawsuits have a lower burden of proof than similar criminal charges, it is still difficult to successfully prove.
Your Belleville injury attorney will first have to prove that the party in question had a duty of care to your loved one. For example, drivers have a duty of care to drive sober and responsibly.
Then you’ll need to prove that the duty of care was breached—either intentionally or unintentionally. Continuing the above example, a driver who is drunk has breached their duty of care to other drivers on the road.

For example, someone who made more money and had multiple children will likely get a larger settlement than someone who was unemployed and had little interaction with the plaintiff.
But, because the details and circumstances vary from case to case, it impossible to accurately predict how much money in damages you can expect from your wrongful death settlement.
