Get the Compensation (and Compassion) You Deserve

Amnesia, mood swings, inability to recognize people or things - sound like a soap opera? While it may read like fiction, these symptoms (and many others) can be a reality for those suffering from a traumatic brain injury. And it’s more common than you think.

One million Americans are treated and released from hospital emergency departments for traumatic brain injury each year, according to the International Brain Injury Association. Further, an estimated 5.3 million Americans are living today with disability related to traumatic brain injury. For many of these Americans, the cause of their brain injury was another person’s carelessness. As personal injury attorneys, we say, "That’s not okay."

What Is a Traumatic Brain Injury?

A traumatic brain injury (TBI) is defined by the Centers for Disease Control and Prevention as a disruption in the normal function of the brain that can be caused by a bump, blow, or jolt to the head, or a penetrating head injury. This disruption in the normal function of the brain can range from mild symptoms, like a brief loss of consciousness, to severe symptoms, such as an extended period of unconsciousness or memory loss.

Brain injury is the leading cause of death and disability worldwide, as well as the leading cause of seizure disorders.

Common Causes of Traumatic Brain Injuries

While you may not think a slip-and-fall is serious enough to cause a debilitating brain injury, falls are actually the leading cause of traumatic brain injuries in the United States. The youngest and oldest members of our population are more susceptible to falls, and are also more likely to be injured when a fall does occur.

After falls, being struck by or against an object and motor vehicle crashes are the most common causes of traumatic brain injuries.

Symptoms of a Traumatic Brain Injury

Because the brain is the decision-maker for all other bodily systems, people suffering from a traumatic brain injury may have cognitive, behavioral, mood, optic, gastrointestinal, sensory, speech, and whole body damage. Specific symptoms may include:

  • Inability to speak or understand language
  • Difficulty focusing or remembering
  • Abnormal laughing and crying
  • Balance disorder
  • Anger or mood swings
  • Dilated pupils
  • Nausea or dizziness
  • Slurred speech

Treatment for a Traumatic Brain Injury

Because the symptoms and effects of a TBI can be so distinctive based on the injury, treatment plans vary. Most often, brain injury sufferers need a combination of treatments: usually medication, surgery, and therapy. A traumatic brain injury often requires specialists as well, including a neurologist, critical care doctor, speech therapist, occupational therapist, and rehabilitation specialist (Mayo Clinic).

Some of these treatments (brain surgery, for example) may be done immediately after the injury in order to save the patient’s life. Other treatments (speech and physical therapy, for example) may extend for years or a lifetime, as patients work steadily to regain daily living skills they had before the TBI.
